A California man accused of managing the computer
system used to send hundreds of thousands of pornography-related e-mail
messages has pleaded guilty to violating a U.S. antispam law. Kirk F.
Rogers, 43, of Manhattan Beach, California, has been found of violating
the U.S. CAN-SPAM Act, this is second-ever U.S. conviction related to
the transmission of obscene e-mail messages.
In another news... Verizon Wireless, mobile phone
service, won a permanent injunction to prevent a Florida company from
sending unsolicited text messages to its customers phones as they
believe this infringed on mobile phone users' privacy. Verizon Wireless
filed the lawsuit against Passport Holidays of Ormond Beach, Florida in
October after 98,000 spam text messages were sent to its customers
phones on behalf of Passport, which will pay $10,000 in damages.
Indian Scenario...
It is really unfortunate that India still does not have any specific
law to regulate spamming, though relief can be claimed under other laws
like under Law Of Torts, as "Nuisance". But such protection makes the
remedy ineffective.
In a consumer case, we have already challenged "Reliance Infocomm" system
of making unsolicited calls offering Fixed WLL phones and also
sending similar Text messages, among other matters, as it infringes privacy. But Reliance has offered not to comment
in the matter as similar matter is before the Supreme Court against all
the Tele-communication companies... which is nothing but an excuse !
As Supreme Court had made some Interim Orders. In any case, this
Verizon case decision will be helpful in the matter.
